Terms and Conditions

1. The promoter of this prize draw is Refresco Drinks UK Limited, a company registered in England with company number 02836071 and having its registered address at Citrus Grove, Side Ley Kegworth, Derby, DE74 2FJ (“Refresco”).
2. By entering the code found underneath the ring pull on your can of Emerge (“Code”) and your email address on our website (win.emergestimulation.com) (the “Website”) and then accepting the verification link sent to the email address you entered (“Entry”), you are deemed to have accepted and agree to be bound by these terms and conditions. If you do not agree to be bound by these terms and conditions, you should not accept the verification link. Refresco reserves the right to refuse entry, or refuse to award a prize to anyone in breach of these terms and conditions.
3. The prize draw is open to all UK residents aged 16 years or over, except employees of Refresco, their families, agents or any third party directly associated with administration of the prize draw.
4. You will be automatically entered into the prize draw upon completing your Entry and as such only one entry can be made per Code. You can opt out of the prize draw by contacting us at uki_infoemerge@refresco.com.
5. The opening date for entries is 12:01 on 7 August 2024. The closing date of the prize draws is 23:59 on 25^th November 2024. If you complete the Entry during this time you will be entered into the weekly prize draws. The first weekly prize draws will take place on the 12th August 2024 and the 15 other prize draws will take place every 7 days after that.
6. Refresco accepts no responsibility for entries not successfully completed due to a technical fault of any kind. Refresco accepts no responsibility if the contact details you provide are incomplete or inaccurate.
7. A winner will be chosen at random performed by a computer process on, 12 August 2024, 19 August 2024, 26 August 2024, 2 September 2024, 9 September 2024, 16 September 2024, 23 September 2024, 30 September 2024, 7 October 2024, 14^th October 2024, 21^st October 2024, 28 October 2024, 4^th November 2024, 11^th November 2024, 18^th November 2024, and 25^th November 2024. There will be a total of 16 winners across the 16 week period.
8. One Code cannot win multiple weekly prize draws. If you win a prize draw that entry will be removed from the entries for the following weekly draws. Any other entries you have made using different Codes will still be valid for future weekly draws.
9. Each winner will receive a £1,000 online Mastercard Their Perfect Gift prepaid card, this card can be used online only and not in physical stores. Further details of the prepaid card and the terms and conditions regarding their use can be found at: https://theirperfectgift.co.uk/. Refresco reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond Refresco’s control makes it necessary to do so.
10. The winner will be notified by email by Refresco’s advertising agency The Individual Agency (using details provided at entry) and acknowledge the email to claim their prize. If a winner does not respond to The Individual Agency within 24 days of being notified by The Individual Agency, then the winner’s prize will be forfeited and Refresco will be entitled to select another winner in accordance with the process described above.
11. Each prize will be sent to the winner by email within 30 days of being notified of their win.
12. The decision of Refresco regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
13. Refresco must either publish or make available information that indicates that a valid award took place. To comply with this obligation Refresco will send the surname and county of the winners to anyone who emails uki_infoemerge@refresco.com or writes to Citrus Grove, Side Ley Kegworth, Derby, DE74 2FJ (enclosing a self-addressed envelope) within one month after the closing date stated in condition 5. If you object to your surname and county being published or made available, please contact Refresco using the above email address. In such circumstances, Refresco must still provide the information and winning entry to the Advertising Standards Authority on request.
14. Refresco reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
15. Insofar as is permitted by law, Refresco, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Refresco, its agents or distributors or that of their employees. Your statutory rights are not affected.
16. Personal data supplied during the course of this promotion may be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the prize. Personal data will only be processed as set out in Refresco’s privacy policy which can be found here: https://emergestimulation.com/privacy-policy/.
17. The prize draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
